Dear California Governor Arnold Schwarzenegger,

It is a waste of our tax money to enforce cannabis prohibition when we have so much violent crime and a budget deficit.

The U.S. Supreme Court this Monday upheld the California’s 4th District Court of Appeal’s ruling that patients enjoy a federally protected property right to their medical marijuana. The main point I would like to make here is that this federally protected property right also applies to hemp. One strategy here is to report this new ruling has changed your mind about hemp and the Feds, and for the cause of global warming you can now support industrial hemp.

What we find in the aftermath of the 1937 Tax Act, is that agricultural production of Cannabis hemp was the probable big target of the law. Hemp (same species as marijuana, different variety) was poised to become the first billion dollar agricultural crop in 1938. Hemp has multiple uses: clothing, textiles, paper, fiberboard, clean biomass fuels, seed protein and oil, and plastics. Hemp had 25,000 viable industrial applications in 1938. We now estimate 50,000 uses for hemp. Now with agricultural production necessary for medicine, what possible reason do we now have to prohibit farmers from growing hemp which may have a medical response, but can not even get you a little high?

Our NAFTA trading partner Canada is now in its tenth year of growing hemp. California would benefit greatly by being the first state to return hemp growing to the American farmer free of the drug war scare. To ignore the bigger picture is to languish in the mistaken belief that the federal government controls everything a state does through the interstate commerce clause of the U.S. Constitution. Our state has the sixth largest economy in the world. California would benefit greatly by forging ahead with hemp growing and research of industrial potential, which is allowed by Article 28, of the Single Convention Treaty on Narcotic Drugs (U.N.), 1961. This is the very treaty on which our federal Controlled Substances Act is based.

All over the world and the United States, the truth about hemp and marijuana is flooding our information highways. We must correct the industrial/political conspiracies, misinformation, and overall mistakes of the 1930’s and legalize hemp and marijuana. Especially considering that “marijuana is one of the safest therapeutically active substances known to man,” as ruled by DEA law judge Francis Young, in September of 1988.

To be ignorant of the history of Cannabis is to invite bad lawmaking. Cannabis sativa is a plant, not a synthetic compound. Any plan to provide for “safe and affordable distribution...” must take into account that it must be grown as an agricultural crop. Not all people have back yards or extra rooms in which to grow plants, or time to grow with a surprise illness. Given that agricultural production is necessary, history suggests we look deeper into the reasons for the morass of law we find ourselves in now.

The plant Cannabis sativa was illegally controlled by the government, through lies and deception, in passing the Marijuana Tax Act of 1937. Depicted as a fatal and dangerous drug marijuana in the hearings of this Act, Cannabis medicine had been used in western medicine since the 1840, and was known to have never been responsible for a single death in 1927 medical literature. Court review by the Drug Enforcement Administration in 1988, stated, “Marijuana, in its natural form, is one of the safest therapeutically active substances known to man.” (DEA Docket #86-22). Medical use in China started more than 5000 years ago.

Finally, we have to look at the legal due process questions of putting people in jail for using such a safe, natural herb for personal recreational purposes, while allowing the proven poisons of alcohol and nicotine to be legal. It is obvious to me from a public health standpoint that we would be better off by replacing both these death dealing drugs with a safer alternative. Competition not prohibition is the American way. Prohibition of alcohol produced a black market, prohibition of marijuana produced a black market, and prohibition of tobacco will also create a black market.

Regulation and freedom will reduce criminal activity, and return a valuable medicine called Cannabis to the California community. And of course even the legal drugs are illegal for children.

The barriers to industrial use of hemp for food, fuel, and fiber damage our environment, our farming industry, and our entire economy. They must be removed at once. I appreciate your taking whatever action is necessary to bring clarity and justice to this enviro-economical, constitutional travesty. I would also appreciate a written reply.

Surely the days of the will of the government superceding the Will of the People are over, unless the new president fails to end hemp prohibition.
Change is rarely easy, but change is here. Like the Boston Tea Party, we may have to throw an American Hemp Party. President Obama already knows about hemp and his Secretary of Commerce, Gov. Bill Richardson, is very pro hemp.

Tell Obama To Let Our Hemp Plant Go At www.change.gov!!!

Things that make me hmmmmmmm! Today I went to www.change.gov and did a search for "hemp" and one for "marijuana".

"We found 0 results for “marijuana” - "We found 0 results for “hemp”

At the www.change.gov site I did a search for hemp and got 3 pages of listings in ideas. That's not enough.

PLEASE GO TO EITHER WWW.CHANGE.GOV OR WWW.CHANGE.ORG AND SHARE YOUR THOUGHTS ON HEMP.

We have an opportunity to take our power back and let We the People control our destiny. Yes the new president will help, but he and his team can't do it for us. That's up to us and we are well equipped to accomplish the task at hand.

Hemp was voted legal in 9 out of the last 10 states where it was on the ballot in 2008. Hemp is the nation's #1 cash crop and capable of helping us solve our problems from health care, to the environment to food shortages.

Yet, hemp is still not part of the conversation because folks are scared. With almost a million people a year having their freedom revoked and their lives endangered for hemp, it's easy to understand the source of fear. What's not understandable is our failure to throw off that fear by now.

The president elect inhaled frequently. So did the governor of California. Yet the government is committed to destroying our lives for interacting with a plant whose only known fatal interaction is DEATH BY BEING ILLEGAL. We've made the peace pipe illegal and wonder why we have a problem with violence. We made effective natural hemp medicine illegal and wonder why we have a problem with too much stress on the health care system. We use toxic building materials while it's illegal to grow hemp for low cost locally produced materials. We while there is no money to bail out the car companies or balance the budget, the hemp trade remains untaxed. Imagine a $20 tax income on every ounce of recreational hemp sold plus prison population reduction savings.

As Richard M. Davis explains so well in his book HEMP FOR VICTORY: A GLOBAL WARMING SOLUTION, hemp scrubs the air of excess CO2 as it grows. Hemp biofuel and biomass burn clean and can do anything toxic energy can do, only without polluting or hurting the planet.

If President Elect Barack Obama is as wise as presented, then he will end this nightmare called making nature illegal and jailing people for interacting with a plant.

I urge you before inauguration day to write, post, webeo, talk about, dance for and on 1/1/09 at 4:20 hook up with like minded folks you love and discuss the issue of hemp legalization. Help the not yet computerized to upload their thoughts onto Youtube and other webeo sites. Get their messages to www.change.gov and www.change.org .

Keeping hemp illegal is not change. Keeping hemp illegal is just more of the same. I remain confident that President Elect Obama stands for real change, the kind we can not only believe in, but experience.

California Approves Plan to Implement Climate Change Law, Sets Precedent for National, International Action

Historic Vote Occurs as World Leaders Negotiate International Climate Deal

(Sacramento, CA - December 11, 2008) California regulators today unanimously approved a plan to implement a law requiring the state to dramatically cut its global warming pollution, setting a precedent for national and international action, according to a law cosponsor. The law cosponsor, Environmental Defense Fund (EDF), praised the California Air Resources Board for its historic vote to approve its Scoping Plan to implement The Global Warming Solutions Act.

The Global Warming Solutions Act (AB 32) is the first statewide effort to cap greenhouse gas emissions. It sets a firm cap requiring the state to cut its emissions to 1990 levels by the year 2020 (about 30 percent below business as usual).

"As world leaders meet in Poland to negotiate an international climate deal, California regulators today set an international and national standard for how to meet aggressive targets to cut global warming pollution that will create a high-wage, clean high-tech economy," said Derek Walker, director of EDF's California Climate Initiative, who just returned from attending the United Nations' climate negotiations in Poznan, Poland that ends tomorrow.

Seven Western states (Arizona, California, Montana, New Mexico, Oregon, Washington and Utah) and four Canadian provinces (British Columbia, Manitoba, Quebec and Ontario) have followed California's lead by pledging to cut greenhouse gas emissions as part of a Western Climate Initiative.

"California already leads the nation in clean tech investment," said Dr. James Fine, EDF economist and policy scientist. "The Air Resources Board's approval of its plan to implement The Global Warming Solutions Act will reinforce this trend. Our state is well-positioned to make enacting this law an opportunity, both economically and environmentally, rather than a burden, as some naysayers suggest. By approving the action plan, ARB is acknowledging definitively that the most expensive option for California is inaction in fighting global warming."

EDF released a report on Monday showing that implementing AB 32 is likely to increase employment in several sectors of the state's economy, as well as associated supply chains, including biomass-based fuels, building and transportation infrastructure construction, clean technologies, environmental engineering, consumer products, information technologies, transportation and logistics, waste management, and water purification and conservation.

"California's businesses and consumers can reap substantial economic benefits from implementing The Global Warming Solutions Act and lead the world in pioneering a green, low carbon economy that sustains our future," said David Festa, vice president of EDF's West Coast Region and a former director of Policy and Strategic Planning at the U.S. Department of Commerce.

California Going Broke - Give Me A Break!!!

It was announced that California is in a budget crisis and going broke. The report is that the state will be out of funds by the spring.

The great and wonderful Tommy Chong said in a/k/a Tommy Chong: A Film By Josh Gilbert 'if the people elect Arnold, then we are truly a nation of retards.' Based on results, as usual Chong was right, unless another stolen election was in the mix.





The Terminator has almost terminated the state's budget while denying hemp, the will of the people as voiced in Prop 215, even though he inhaled.




It is continued insanity to pretend not to know we can solve our economic crisis with hemp.

California will run out of money by the spring UNLESS they immediately remove all restrictions from the hemp plant and generate a tax revenue from the state's #1 cash crop immediately.

Tax industrial and medical grades at standard business rates and recreational hemp at 20%. If any state gets up to 20% on all recreational hemp sold, there would be no budget crisis.

How? Legalization and large scale hemp growing would bring the price down to about $100 an ounce...plus a $20 tax. There are millions of high grade hemp consumers who would gladly pay the tax to remove the drama.

In this year's election hemp won in 9 out of 10 states where it was on the ballot. The will of the government got us into this mess. The Will of the People, hemp, can get us out.

Eulogy for Sister Somayah Kambui by Dr. Jeri Rose

This eulogy was written by Dr. Jeri Rose, who was Doctor of Chiropractic for Sister Somayah and for the Crescent Alliance Self Help for Sickle Cell before she moved to Hawaii. She asked me to read this for her here today.

On November 10, 2008 Miriam Makeba, Mother Africa died. On Dec. 3, 2008 Odetta Holmes died. Miriam was there to help Somayah home and they both welcomed Odetta. These great three singing women who sang for the African Nigretian people passed together. The other two were in their 70’s; Somayah was the baby twenty years early and not nearly adequately recognized and celebrated for her creative and beautiful songs.

She was Herowese Moore, Sister Somayah, Queen Negus; three names because this was one intense, complicated woman of whom we can say that she has died, passed over, will never visit Africa. Her death ends the possibility of her letting us see her do more. What she did not do, she did not get Cannabis legalized federally, but she did get to grow the plants in her yard for her own health. She did not go to Africa, but she did uplift those who were descendants of those who came here unwilling stolen from Africa.

She was not easy and she deserves a novel to illuminate her. I will try to avoid writing a novel here, but she was so much like all of us that she irritated us, and she was unique and fascinated us. Each person decides at some critical point in life how true to themselves they will be. Some give it all up to what society demands, some turn their back on that siren call of the herd and strike out on their own path. At every crucial turn, the decision is bartered and renegotiated. Every time Sister Somayah went to the VA hospital she went against her own path. She tried to create a community out of her own concern for her community. She was generous and yet she needed a similar generosity that she did not demand. Most of us learn a selfish survival skill to take care of ourselves and then if we also have heart and spirit, we look around to help those we can. This was not Sister Somayah’s way. She gave until she could give no more and then in her need she was invisible because she did not know how to ask for help.

She had acceded to society by joining the air force. That society owed her, so she felt no shame; she could go to the hospital it provides.

She had grown to support her people, joined the Black Panthers and served the children breakfast and survived the societal onslaught of the police attack on that group because of the wisdom of Geronimo Pratt. He had learned in the same war how to stop bullets with sandbags. They were prepared and that house was protected as no other Black Panther house. Geronimo Pratt went to jail on a false charge that was known to be false by the government that hid the evidence of his innocence.

That same government knows that the herb that could have saved Sister Somayah is innocent of harm, yet it continues to tell lies and cover up the truth about it because of power and greed. Every time Sister Somayah had to go to the VA hospital and get hooked again on morphine because she did not have enough herb to make her butter, she felt that she had failed her community and she felt a lack of love from that community that did not support her.

The truth is we loved her and could not love her enough. Perhaps only the mother she was calling upon in her last days could love her enough. However, we can leave here; leave this gathering knowing that we need to do more for each other to enable us to live our true path because it gets very lonely walking alone trying to live a personal truth. I know I am speaking a harsh truth, but it is one we need to all hear because the herd is stupid and the powerful are greedy stupid.

The planet is at risk because we use oil instead of making our fuel from hemp. A sick planet, the LA smog that poisoned Sister Somayah’s lungs, poisons all trying to breathe free in this place and we are all sick and need herbal medicine and clean air so we will not need so much herbal medicine and will be naturally healthier. The government sent me a pamphlet that said that 114 million tons of toxic pollution is put into the LA air basin each year. Only 9 million of those tons are smog, so even on a clear day, you are being poisoned and the government knows and allows it. Alcohol, commercial tobacco laced with 400 toxic poisons including uranium, are legal. The government knows and if it can keep you at your daily struggle for rent and food money, quietly getting sick and dying in its hospital temples of poison pandering to corporate greed, then it has won. Sister Somayah fought in the revolution that was not televised and there were no cameras there to tell the world of her death.

The corporations own the airwaves and pollute the air so they own the air. They own the water and food that supplies your bodies and alters your minds. Sister Somayah’s death might liberate you if you can learn to turn your back on the siren call of the herd concerned with fashion, cars, television, gadgets and goods. They are so busy that they can not find the meaning of their lives or have an inkling of being individuals. Until you examine the beliefs that you take for granted, thinking they must be true since they guide everyone you know, you are not a free person capable of knowing yourself.

Sister Somayah knew more than most that the society she was in was stacked against her. She lived in the light of that truth. She fell into despair and stopped eating and she was human and afraid of pain. She checked into the VA and allowed herself to be obliterated by morphine. That ending does not define her life.

Her songs, her art, her tenacity and love define her life. She was a glory to know, but she was like all of us mortal and frail. She needed us to help each other, and sometimes she was one of the others. She created the Crescent Alliance for Self-help for Sickle Cell. The Crescent of her cells and the Moslem crescent that engaged her loyalty did not prevent her from helping others outside of that narrow concern. She embraced everyone. She held hope for everyone until she lost that hope for herself. Her legacy is in her life. She calls us to find a way to keep ourselves loving and hoping together. She lived to see a president elected that signaled the end of the old racism.

Obama knows the consequences of the old racism. He is not black enough to know about the new racism. The new racism will eradicate the human race unless we stand up against it. We vote with our dollars and our awareness. The powerful only respect the dollar. The awareness turns away from the power that does not create a caring society. Stop bowing to the money the powerful offer for your allegiance to them. That allegiance will kill you. Find a way to live healthy and get out of Hell A. I don’t like the way sister Somayah did it, but she finally did leave it.

I know she is not lost to us; her heart left a large wake of love.

"You know, she first got in touch with me in the middle of the night nearly 20 years ago.

The phone rang, I answered, and someone was screaming at me. I hung up. Two weeks later or so it happened again. And again.

I kept trying to find out who the person was and what they wanted, but l I got were names hurled at me.

I had no idea what I'd done or to whom I'd done it. But someone was sure angry with me.

It probably took six months before I could get her to slow down and take a breath and tell me what as wrong, and why she had to keep waking me at 3 AM and 4 AM.

She said she called when the pain from her sickle-cell got unbearable. If she was going to suffer, others were too. As I wrote for High Times on medical-marijuana, she took my not writing about sickle-cell as a racist thing. Therefore I had to pay with her tirades.

I told her I knew nothing about sickle-cell--didn't even know what it was, and so surely didn't know marijuana could help. Then she schooled me. She had me look up articles, call hospitals to see how it was treated, that sort of thing.

And with that information, we were able to begin including sickle-cell in the disease categories that could be managed/treated with cannabis.

I'm guessing she's arguing with St. Pete right about now. And I'm going to bet she gets in as well.

There is much courage to be found in the life of Sister Somayah Kambui, who is a USA Hemp Museum designated Hemp Hero because of her work in the fields of medical hemp and sickle cell, her agricultural skills, her roles in both the language and passage of Prop 215, America's first state to pass legislation legalizing the nation's #1 cash crop, and producing the first ten Million Global Marijuana Marches in Los Angeles. In one of the marches she is seen carrying a live hemp plant down the parade route with a full police escort.

We should learn the lessons of the past.

Bill Richardson, should first end all hemp prohibition and immediately institute a fair tax income dedicated to solving our problems now. Issue micro loans for small businesses and post all public job opportunities that come out of the new works programs.

A hemp division should be instituted in the Departments of Agriculture, Commerce, Labor, etc. to help folks use hemp to empower their lives. From coordinating maximum crop growth to job opportunities to market delivery, the government stands to make a fortune supporting and taxing the nations number one cash crop.

Encourage President Elect Barack Obama and nominated Secretary of Commerce, Gov. Bill Richardson, to pull an FDR and end hemp prohibition now. Post your thoughts on hemp at www.change.gov . I have a correction to report. I said in earlier blog entries that it was Thanksgiving Day that Los Angeles' Sister Somayah Kambui pass.

The family has released the final details of her passing and she passed the day after Thanksgiving, 2008.

Forgive me. I still can't comprehend not being able to hug her again.

Cops Say Legalizing Drugs Can Boost Economy by $76.8 Billion; 75th Anniversary of Alcohol Prohibition's End Inspires Modern Effort

WASHINGTON, Dec. 2 (AScribe Newswire) -- Today, a group of law enforcers who fought on the front lines of the "war on drugs" and witnessed its failures commemorated the 75th anniversary of alcohol prohibition's repeal by calling for drug legalization. The cops, judges and prosecutors released a report detailing how ending today's expensive prohibition would provide a $76.8 billion-a-year boost to the ailing economy.

"America's leaders had the good sense to realize that we couldn't afford to keep enforcing the ineffective prohibition of alcohol during the Great Depression," said Terry Nelson, a 30-year veteran federal agent and member of Law Enforcement Against Prohibition (LEAP). "Now, cops fighting on the front lines of today's 'war on drugs' are working to make our streets safer and help solve our economic crisis by teaching lawmakers a lesson from history about the failure of prohibition. We can do it again."

In a paper released today, Harvard University economist Jeffrey A. Miron conservatively estimates that ending drug prohibition will result in annual savings of at least $44.1 in enforcement expenses and will generate additional tax revenue of at least $32.7 billion.

The economic paper is accompanied by a historical report, "We Can Do It Again: Repealing Today's Failed Prohibition," which highlights how the "war on drugs" - just like alcohol prohibition - has subsidized violent gangsters, endangered public health and diminished public respect for the rule of law. The report also details how the newer prohibition comes with the much graver threat of international cartels and terrorists who profit from illegal drug sales. Yet, it leaves readers on a hopeful note.

"We're starting to see an emerging consensus that drug prohibition just doesn't make sense," said Seattle's retired Police Chief Norm Stamper, a LEAP member. "Three out of four Americans now say the 'war on drugs' has failed, and so do the U.S. Conference of Mayors, the National Black Caucus of State Legislators and the National Hispanic Caucus of State Legislators. Now, it's up to the new administration and Congress to follow through."

"OTTAWA – Researchers say they have located the world's oldest stash of marijuana, in a tomb in a remote part of China.The cache of cannabis is about 2,700 years old and was clearly "cultivated for psychoactive purposes," rather than as fibre for clothing or as food, says a research paper in the Journal of Experimental Botany.

The 789 grams of dried cannabis was buried alongside a light-haired, blue-eyed Caucasian man, likely a shaman of the Gushi culture, near Turpan in northwestern China.

The extremely dry conditions and alkaline soil acted as preservatives, allowing a team of scientists to carefully analyze the stash, which still looked green though it had lost its distinctive odour.

"To our knowledge, these investigations provide the oldest documentation of cannabis as a pharmacologically active agent," says the newly published paper, whose lead author was American neurologist Dr. Ethan B. Russo.Remnants of cannabis have been found in ancient Egypt and other sites, and the substance has been referred to by authors such as the Greek historian Herodotus. But the tomb stash is the oldest so far that could be thoroughly tested for its properties.

We now have a pro hemp president and secretary of commerce elect, poised to make great, positive changes. Shifting back to a hemp based economy can have a powerfully healing effect, but we have to use our balls and demand the unconditional removal of all restrictions regarding the hemp plant and let it assume it's rightful place in the marketplace.

1. Include tax revenue from the #1 cash crop in the nation. The governor of California is crying about not having enough money while he continues to veto hemp bills that could provide a subatantial revenue to city, state and federal governments.

U.S. Supreme Court: State Medical Marijuana Laws Not Preempted by Federal Law

Medical marijuana case appealed by the City of Garden Grove was denied review today Washington, DC -- The U.S. Supreme Court refused to review a landmark decision today in which California state courts found that its medical marijuana law was not preempted by federal law. The state appellate court decision from November 28, 2007, ruled that "it is not the job of the local police to enforce the federal drug laws." The case, involving Felix Kha, a medical marijuana patient from Garden Grove, was the result of a wrongful seizure of medical marijuana by local police in June 2005. Medical marijuana advocates hailed today's decision as a huge victory in clarifying law enforcement's obligation to uphold state law. Advocates assert that better adherence to state medical marijuana laws by local police will result in fewer needless arrests and seizures. In turn, this will allow for better implementation of medical marijuana laws not only in California, but in all states that have adopted such laws."It's now settled that state law enforcement officers cannot arrest medical marijuana patients or seize their medicine simply because they prefer the contrary federal law," said Joe Elford, Chief Counsel with Americans for Safe Access (ASA), the medical marijuana advocacy organization that represented the defendant Felix Kha in a case that the City of Garden Grove appealed to the U.S. Supreme Court. "Perhaps, in the future local government will think twice about expending significant time and resources to defy a law that is overwhelmingly supported by the people of our state."California medical marijuana patient Felix Kha was pulled over by the Garden Grove Police Department and cited for possession of marijuana, despite Kha showing the officers proper documentation. The charge against Kha was subsequently dismissed, with the Superior Court of Orange County issuing an order to return Kha's wrongfully seized 8 grams of medical marijuana. The police, backed by the City of Garden Grove, refused to return Kha's medicine and the city appealed. Before the 41-page decision was issued a year ago by California's Fourth District Court of Appeal, the California Attorney General filed a "friend of the court" brief on behalf of Kha's right to possess his medicine. The California Supreme Court then denied review in March."The source of local law enforcement's resistance to upholding state law is an outdated, harmful federal policy with regard to medical marijuana," said ASA spokesperson Kris Hermes. "This should send a message to the federal government that it's time to establish a compassionate policy more consistent with the 13 states that have adopted medical marijuana laws.
