Hemp Hero Dr. Jeri Rose - Setting The Record Straight

There is so much mis-information in the modern marijuana movement it's scary some days.  Some folks are profiting handsomely while many of the folks who have been working on this issue for decades are thrown out like old dishwater, called greedy and frauds.  This post is to help set the record straight about hemp hero Dr. Jeri Rose, whose contributed money, skills, ideas, organizational talents, etc. for decades and now lied on terribly by someone who obviously does not know her.  

I was reading an article called Narc vs. Narc about the players in the modern medical marijuana game.  I tried posting in the comments section but they refuse to put up my comments in response to the slanderous remarks posted there which can be summarized in one sentence.

"Shame on you to use Jack Here name. You are not honoring him. If you honored him then his wife, Jeanne Here would not be suffering today. Not one dime of your so called Jack Here Honore money is going toward helping her. The Pioneers should not be the only one to keep her out of poverty. Below is the response (a couple of grammatical corrections from the original) that has not yet been approved by the folks who published the article at The Green Pulpit Narc vs. Narc on July 16, 2014. 

'You must not know about Dr. Jeri Rose.  What “we” are you referring to who started this movement since it began with the Marijuana Tax Act of 1937? Since Dr. Rose has been consulted with frequently by many movers and shakers in the medical and industrial marijuana movements, how is she a fraud?  Dr. Rose has not charged anyone I know of in the movement for her constant, accurate advice, so how is she greedy?

I thank God for haters because it’s usually the step before they become appreciators.  The work and other contributions of Dr. Jeri Rose is legendary among many hemp researchers.

Dr. Rose is a hemp activist since 1989 where she worked to get the hemp message onto national television three years in a row by marching in the Doo Dah Parade in 1989, 1990 and 1991.  I’ve known Dr. Rose since 1999 when we met working with Sister Somayah Kambui producing the first Los Angeles Million (now Global) Marijuana March.  Dr. Rose was instrumental in helping Sister Somayah research and organize Somayah’s work with medical marijuana and sickle cell.  Somayah was able to double her life expectancy using marijuana to help manage her sickle cell.  Their work got sickle cell listed on Prop. 215’s list of approved medical conditions for medical marijuana with Somayah’s life standing as proof of the “theory”. Dr. Rose remained an adviser to Somayah way beyond the point of Somayah being the first acquittal of marijuana charges under Prop. 215.

Over the years, I've witnessed since 1999 Dr. Rose has helped many independent activists.  Her generosity in various research communities is priceless.  She is NOT a fraud nor greedy.  My experience of her is she has not taken any money for the work she has done for Jack Herer, Richard M. Davis and countless others in the marijuana movement, Dr. Rose is not greedy and she knows her shit.

Keep in mind that’s just the little bit I know about, can testify to from direct experience concerning the impact of her contributions. There are many, many more I’ve only heard of.

In case I failed to make my point, Dr. Jeri Rose is NOT a fraud nor greedy.  She is a good, generous, intelligent soul who has dedicated a large part of her adult life to not only ending the drug war but implementing the hemp solution to many modern problems.  She’s done better than the best she could to accomplish and implement the mission of hemp for victory. I’m learning to accept that for some people no matter what one does it will never be enough.

To understand the greed in the modern marijuana movement, as in has the money and is not sharing it with the folks who helped make it possible resulting in a reality that has some in mansions and others living out of their vans, I suggest a re-read of this excellent article NARC VS. NARC 2: THE CALIFORNIA CANNABIS COUP D’ETAT. 

Follow the money and please, please, please ask those with funds to support Jeannie Herer, Jeff Clark, Dana Beal… Consider re-directing the energy put into hating on a soul who gave everything she had in the last century plus, (and is still working the best she can with what she has) into positive steps to end the drug war now. Falsely accusing hemp heroes is a big waste of time and energy.

Los Angels City Council Marijuana Decision Is Illegal

FOR IMMEDIATE RELEASE       

                                                      

Los Angeles, CA Hemp Hero Richard M. Davis, USA Hemp Museum’s founder and curator, author, hemp farmer and activist, is taking on the corrupt Los Angeles City Council’s decision to close down all but 100 medical marijuana dispensaries.  The press and public are invited to his museum, every Saturday and Sunday, 12 noon-6 p.m. 1358 S. Flower Street, Los Angeles, CA for a free museum tour.  Come by to discuss and implement effective ways to implement the hemp solution to our problems now. 

Davis contends that despite a recent court ruling, the Council voted to take medicine away from sick people while turning the market over to 100 of their “lottery winners”.  He said “Once again, the City Council is in violation of the Will Of The People.  Their decision to shut down over 600 legal dispensaries, store front and mobile, is a violation of the July 2, 2012 Second Circuit Court decision (Los Angeles County Super. Ct. No. BC457089) regarding Prop 215, SB 420 and Health and Safety Code section 11362.5 is an obtuse abomination. The court’s decision reads:  

‘We conclude state law preempts County’s ban. - DISPOSITION - The order granting a preliminary injunction is reversed, our stay of the injunction is dissolved when the remittitur issues from this court, and the matter is remanded for further proceedings consistent with this opinion. Defendants are entitled to their costs on appeal.”  So who do they think they are? In light of the above decision, the council’s vote to close down most of the marijuana dispensaries reeks of all forms of corruption.”  Davis is asking the City Council to answer these questions for the people:

1.      Have you considered how many dispensary jobs will be lost as a result of your closing down not only over 600 legal marijuana dispensaries but stifling the growth of the mobile hemp industry?  What about the many service jobs lost?

2.      Have you considered the monopolies you will be creating among the 100 lucky lottery winners of dispensary owners?  How do we know that the lottery is not fixed to match contributions/bribes or other in kind donations?

3.      What about the Angelinos comfortable with their dispensary team that knows their case and condition, being forced to stand on even longer lines?

4.      What about the children who depend on their parent’s dispensary jobs for their education, their very lives?  What message does it send them?

5.      What benefit is it to the City Council members to impose these limitations? Could it be graft? Is it time to do the right thing?

So what can we learn from this? Wisdom dictates that we use medical marijuana to address this and other health issues that medical grade and higher of hemp heal.  The government needs to stop the drug war so people can be free to use marijuana to solve our problems, beginning with our health and expanding to include our world’s problems with the economy, environment, food, water, energy, textile and building materials… just to name a few. 

An example of how hemp prohibition is wrong is found in the book HEMP FOR VICTORY: THE WONDER HERB by Richard M. Davis.  Peter McWilliams was murdered by the government denying him medical marijuana which he was using to help him manage his vomiting from chemo treatments.

"The prosecutors made it clear there was no room for compassion in federal drug law and denied the Judge's request.  Five days later Peter died because, by court order, he did not have the hemp medicine he needed to manage his nausea.  Murder by government."

Lord, please don't let the same thing happen to Marc Emery, a heroic Canadian hemp seed merchant and broadcaster and publisher, who contracted MRSA while serving as a political prisoner in a US jail. Since Marc contracted MRSA in jail, he should be granted unconditional access to medical marijuana for healing purposes immediately, as should all medical marijuana patients in prison too.

Anything else is inhumane.

Tell all elected and appointed officials to stop the drug war and re-start the HEMP FOR VICTORY program.  

Hemp For Victory: A Peaceful Solution To Gulf Oil Crisis

The Lord has a sense of humor, really. Turns out a plant that is now illegal holds the key to solving the oil crisis in the Gulf.

From what Willie Nelson calls A Peaceful Solution, nature's hemp plant, we have a full arsenal of tools in this weed's various grades of THC to fight this crisis in fields as vast as medical, industrial, environmental, economic and agricultural.

The potential consequences from this environmental crisis in the Gulf of Mexico and beyond are way too precise to ignore.

Hemp is a wind pollinated plant that has a short growing season.  Hemp foods can help replace the whole in the food supply caused by not eating fish from the Gulf or possibly the east coast by the time hurricane season finishes. 

Hemp's environment benefits are deep as its up to 6' root system aerates soil and converts many toxins into wood. Hemp should be planted in all toxic areas to help clean the soil.

THE MEDICAL MARIJUANA MESS IN L.A.

The Los Angeles City Council met on Wednesday to further discuss the fate of some 800 dispensaries that provide medical marijuana to the millions of citizens of the city.  I attended that meeting and heard the discussion.  I did not get a chance to speak, so let me take this opportunity to put in my two cents on the subject.  
 

My name is Richard M. Davis author of the HEMP FOR VICTORY book series: A GLOBAL WARMING SOLUTION,  THE WONDER HERB  and THE TRILLION DOLLAR CROP .  I am a court stipulated expert witness on marijuana and hemp ( the two varieties are tied together under the drug laws),  the founder and curator of the USA Hemp Museum (www.hempmuseum.org), a medical marijuana patient and caregiver for a bunch of people,  a citizen and voter in this state, a marijuana felon,  a nuclear veteran,  with forty years smoking and growing Cannabis.  I have testified in Steve Cooley’s court (People v. Sister Somayah Kambui) as caregiver for the defendant, and sued to have Senate Bill 420 declared unconstitutional in Superior Court.

I believe that the power and freedom given to the people of California is unique in the world.  We possess as individuals inalienable rights given us by the people through the California Constitution:

“Article I, Section 1.  All men are by nature free and independent, and have certain inalienable rights, among which are those of enjoying and defending life and liberty; acquiring, possessing, and protecting property; and pursuing and obtaining safety, happiness and privacy.”

From our Declaration of Independence, an inalienable right is one given us by the Creator.  We in California were given a bunch of these rights.  To me they all say I can grow a God given plant.  Period.  Case closed.  What we citizens need to recognize is that all marijuana laws are bogus.  Just look above at the rights I have.

1.        I was told by the Second District Court of Appeals that I had no standing to challenge S.B. 420 as I had not volunteered for its conditions.  S.B. 420 is a voluntary law!  I am not covered by that law in any way; I have that in writing from the Attorney General, who I sued.   The fact is the court refused to shoot down this unconstitutional law for me in my case because it was not “ripe” for determination.  The appeals court since has ruled that plant limits are unconstitutional for the very reason they were not sent back to the people for a vote.  An unconstitutional law is no law at all and need not be obeyed.  They simply did not follow the constitution.  S.B. 420 is void.

2.       Look at the mess this unconstitutional law has brought.  By constitutional law, a statewide measure (like the Compassionate Use Act of 1996, must be instituted evenly statewide.  This was not done, but given to 58 California counties and hundreds of cities to concoct hundreds of different medical marijuana laws, licenses, bans, taxes.  This violates the spirit and letter of our act which authorized a safe and affordable distribution to ALL Californians.

3.       The only viable marijuana law in force in California is the Compassionate Use Act of 1996.  If City law does not follow the Compassionate Use Act of 1996, but amends or changes it in any way or restricts its implementation it will be unconstitutional unless sent back to the people of California for a vote (just follow the law).

4.       The question of federal jurisdiction comes up again and again.  Here is my take.  If the federal government could have stopped medical marijuana in California in 1996, they would have.  The facts are they could not stop medical marijuana and here is why.   In California the people have all the power.  The power of the federal government is limited by the U.S. Constitution.  Rights and powers not specifically enumerated in the Federal Constitution are reserved to the states or the people.  There is no federal power spelled out over medical marijuana, so it was up for grabs (so to speak) through the Ninth and Tenth Amendment, and the people of California got there first.  The feds and the state governments were left out in the cold.  To really complicate matters in 2003, the state tried to use the power of the Ninth and Tenth Amendment to establish the power to set up an entire medical marijuana program that amended the Compassionate Use Act of 1996 in numerous ways, and failed to send it back for that vote by the people.

5.       Every person in California has the right to obtain and use medical marijuana for any ailment for which marijuana provides relief.  The California Supreme Court in People v. Mower called the rights and powers in the CSU of 1996, guarantees.  We need to guarantee that all people of California are served with medical marijuana.  New freedom is often not popular.

6.       Our initiative law (again unchallenged by the federal government) allows both concentrated and edible marijuana as medicine.  Amendments must be sent back to the people of California.

7.       What about the “free market” that we all profess to believe in?  It is the restrictions that create the black markets.  If a business is not profitable or reliable, won’t it fail?  And to answer the question of sales we did authorize an affordable distribution, meaning money will change hands, and we the people of California control medical marijuana even sales, not the feds.  The spirit and letter of the law is to make medical marijuana available to ALL Californians in need.  Please follow that spirit.

8.       I believe the definition of primary caregiver can be read to include a primary caregiver for safety.  Again safety being an inalienable right of individuals, it is our right to name whatever protection for that safety.

9.       The CA Supreme Court in People v. Mower that medical marijuana must be treated like any other prescription drug.  Any tax on medical marijuana would constitute an amendment to the Compassionate Use Act of 1996 which requires no tax on medical marijuana.

10.   Lastly I heard the City Council say they needed tax money from medical marijuana.  I wonder if they know that the money for California is not in medical marijuana taxes, but in a new resource we get when the plant is legal for us all.  Hemp for paper, fiber, fuel, plastic, food, medicine and recreation.  Our latest book on Amazon is Hemp For Victory:  The Trillion Dollar Crop.  The marijuana prohibition is a smokescreen to prevent the growing of hemp as a resource.

Limiting anything having to do with medical marijuana such as limiting access, or taxing patients, or I.D. cards seems to violate the spirit of the Compassionate Use Act of 1996.  History will note that this act helped end the prohibition of Cannabis/hemp/marijuana.

THE GENERAL IDEA

For as long as I can remember, the debate over cannabis has centered on whether it is harmful. I would like to focus instead on marijuana's uses and possible benefits. Some ten million Americans smoke marijuana regularly. Millions more use it occasionally. But why, exactly? I know that some people use marijuana as a medicine, while others use it simply to "party." But between these two poles are many other uses and effects that might best be described by words like enhancing, therapeutic, exploratory, expansive, and so on. The Uses of Marijuana will explore these various possibilities. I hope you will join me by writing about your experience.

Here are a few suggestions:

You could write a personal essay or contribute to our blog -- serious, whimsical, or some of each -- about the place of marijuana in your life, or why you use it, or what you especially enjoy about it.

Or you could cover the same ground in other ways: by exchanging a series of letters (or e-mails) with a friend and sending them on to us; by writing up a dialogue about marijuana with your spouse or partner; by sending sections from a journal; or perhaps even by keeping a journal for a few weeks and sending us some excerpts from it.

Or you might write up an interview with yourself on the subject of marijuana, or ask a friend to interview you; or send us something you have already written on this subject -- or any other writing about marijuana that you'd like us to be aware of.

Whether or not we can use your name, please identify who you are and how to contact you. And kindly provide at least four basic details: your age, your gender, your occupation, and what part of the country you live in. If you'd like to identify yourself further, please do.

Submissions to The Uses of Marijuana should be typed and easy to read. Longer contributions are fine, but whatever you send, please keep a copy. I hope to respond to all contributions within 2-3 weeks. If you have questions or comments about this project, I'll do my best to respond.

About The Author

Richard M. Davis is the USA Hemp Museum’s founder, curator and resident hempologist. He’s known in California for his growing skills and his love of and dedication to restoring the hemp plant to its rightful role in nature. Federal judge postpones medical marijuana sentencing

"A federal judge in Los Angeles this morning postponed the sentencing of a man who emerged as a key figure in the national debate over medical marijuana, saying he wanted additional information about a reported change in the Justice Department’s policy regarding such prosecutions.

U.S. District Court Judge George H. Wu asked prosecutors for a written response from the Justice Department about its position on medical marijuana prosecutions in light of recent comments from Atty. Gen. Eric H. Holder Jr.

Holder said last week that the Justice Department under President Obama had no plans to prosecute dispensary owners who operated within their state's law.

Wu said he did not believe that any change in policy would affect the conviction of Charles Lynch, 47. But the judge said he wanted to consider any new information about the policy before imposing sentence.

Lynch’s trial this summer showcased the issue of conflicting state and federal marijuana laws. "

What about the rest of us? Are we free to interact with nature or must we continue to be fodder for Prison, Inc.? (Lord bless the law enforcement folks who have come forward in support of ending the drug war.)

Must we continue to pretend not to know hemp can help us solve our problems?

If it is at least possible for us to use hemp can we begin now?

President Obama said at his health care conference at the White House this week that "...data and evidence have to drive the practice." Data and evidence indicate the need for the immediate end of hemp prohibition and the institution of a hemp empowerment strategy.

Though the federal government has indicated an inclination to remove hemp restrictions, we are in need of clear policy on the issue. A simple memo from Attorney General Eric Holder ending the war on drugs would begin the process.

President Obama recommended this weekend that we endure and find opportunities in this time of crisis. The President should declare the Hemp Empowerment Program. HEP should be created with the wisdom of pro hemp congresspeople i.e. Barney Frank, Ron Paul and Dennis Kucinich, as well as hempsters Richard M. Davis here at the USA Hemp Museum, Jack Herer, Chris Conrad, Dana Beal, Attorney Bruce Margolin, Dr. Lester Grinspoon, Willie Nelson, Montel Williams, Tommy Chong, Woody Harrelson, Marijuana Policy Project, Vote Hemp, North American Industrial Hemp Council, Hemp Industries Association, Bill Maher, Bill Press and other hemp activist, entertainers, organizations, businesses, researchers, journalists and farmers to co-create positive results. Let's not fail to create a place for the customers to join in the building process.

There are hundreds of thousands of people in jail for interacting with a plant.

LET OUR PEOPLE GO. FREE ALL NON VIOLENT WAR ON DRUGS PRISONERS. ALLOW NATURE LEGAL STATUS.

We have no time to waste. Tell the government to end the war on drugs, which is really a war on We the People who are working to be free once again.
