VOTE NO ON PROPOSITION 19 by Richard M. Davis, USA Hemp Museum

The people of California have the right to legal marijuana from Prop. 215.  Every citizen with no age limit and a doctors note has the right to use and obtain legal marijuana, including cultivation with no plant or square foot limitations, as much as you need for medical use.  The Supreme Court called these guarantees.

The problem is that these guarantees can be taken away by the people in another initiative such as Prop. 19.  How can that happen?  In California the people hold all the power.  CA Constitution, Article 2 VOTING, INITIATIVE AND REFERENDUM, AND RECALL, Section 1,  “All political power is inherent in the people.  Government is instituted for their protection, security, and benefit, and they have the right to alter or reform it when the public good may require.”

One point here is that what we have the right to alter is not always for the public good.  Like 538 new local laws Statewide in California.  Or like destroying the Constitution to give me an ounce of pot and a postage stamp garden.

NO NEW RIGHTS.  NO ON PROP. 19.

Listen to this scenario.  CA Constitution, Article 1 DECLARATION OF RIGHTS, Section 26, “The provisions of this Constitution are mandatory and prohibitory, unless by express words they are declared to be otherwise.”  Does Prop. 19 contain words that declare this section other than mandatory and prohibitory?  How about in Section 11301: “Notwithstanding any other provision of state or local law,” isn’t the Constitution included in state law? And are not your inalienable rights included in state law?  How can Prop. 19 get away with changing the Constitution? 

CA Constitution, Article 18 AMENDING AND REVISING THE CONSTITUTION, Section 3, “The electors may amend the Constitution by initiative.” 

Since Prop. 19 doesn’t tell us they are destroying the Constitution to turn total control over to 538 local governments in California, let’s point to some changes in Prop. 19 that would be unconstitutional without the above paths to alter the Constitution.

1.    The legal age limit of 18 years old is changed to 21.  CA Constitution, Article 2 VOTING, INITIATIVE AND REFERENDUM, AND RECALL, Section 2, “A United States citizen 18 years of age and resident in this State may vote.”  All citizens must be granted the same terms, regardless of age.

2.  CA Constitution, Article 1 DECLARATION OF RIGHTS, Section 7:  (b) A citizen or class of citizens may not be granted privileges or immunities not granted on the same terms to all citizens.  Privileges or immunities granted by the Legislature may be altered or revoked.”  18 TO 21 year old citizens have been left out of Prop. 19 because of focus groups that may not have read the Constitution.

3.  CA Constitution, Article 4 LEGISLATIVE, Section 16, “(a) All laws of a general nature have uniform operation.  (b) A local or special statute is invalid in any case if a general statute can be made applicable.”  The Constitution does not want 538 different laws about anything.   Local control on such a statewide concern would lead to chaos.  A general statute would be applicable here to protect equal rights of all citizens across the state.

4.  

     CA Constitution, Article 1 DECLARATION OF RIGHTS, Section 3:  “(4) Nothing in this subdivision supersedes or modifies any provision of this Constitution, including the guarantees that a person may not be deprived of life, liberty, or property without due process of law, or denied equal protection of the laws, as provided in  Section 7.”  Against local control 538 ways there is no equal protection.  Prop. 19 is bad law.

5. CA  Constitution, Article 13 TAXATION, Section 20, “The Legislature may provide maximum property tax rates and bonding limits for local governments.”  Prop. 19 changes this Constitutional provision to give local governments the unlimited power to tax (“Notwithstanding any other provision of state or local law.”), “including imposition of appropriate general, special or excise, transfer or transaction taxes, benefit assessments, or fees, on any activity…to raise revenue.”  That means the taxes by local governments could be prohibitory and essentially ban even medical marijuana cultivation or sales in 538 different ways from 538 different local governments.

VOTE NO ON PROP. 19

Don’t let the word Cannabis in the title fool you.  This is a marijuana act not a Cannabis act.

How To Use Hemp To Clean Water

With around 70% of the earth covered in water, it's time to rethink the claims of fear regarding this water shortage.  Those who speak of it are generally accurate, as in if we keep going the way we are, the crisis is already in process.  However hopeless the times seem, this is the promised age of great, positive change. Fired up, ready to go!

Water purification systems that transform ocean water into drinking water, built and powered with hemp, financed by a recreational grade hemp tax, are how to solve this problem. Instead we're told to be in fear as this simple solution remains illegal in the US. Los Angeles, Phoenix, New Orleans, Miami, Washington, New York, Boston and other cities can process ocean water into clean water efficiently, economically and abundantly from this quickly grown, easily renewable, wind pollinated weed.    A secondary benefit is to take the strain off of our river system so they can heal.  For example, the Colorado River seems to be dying feeding Las Vegas, Phoenix and Los Angeles' clean water needs. 

Are you tired of the tail wagging the dog yet?  It's as if the old 'city vs. country dweller', 'them vs. us', 'divide and conquer' battle lines are being drawn.

Farms looked at as water resources vanish

"But if farmers go out of business, the crops they sold in Arizona would be imported from another state or country. As their water is claimed by new development, cities would lose the backup water source, which would become more important if droughts worsen as climate scientists predict.

In 2007 and 2008, a group of water managers, farm-industry representatives and university researchers traveled Arizona asking farmers about the future of agriculture. The farmers were clearly worried.
"They were concerned about having enough water for the future," said Chris Udall, executive director of the Agribusiness Council of Arizona, a group that works to protect farmers' water rights. "There are a lot of farmers who want to stay in business.""

Don't fall for the lie.  We are in this together and together we can fix this.  We are limited only by our imaginations, which are vast.

There is plenty of water on the planet. We just need to show it some hemped love to transform it into safe drinking water.  Though there will be extensive discussion on this subject in future blog entries, here's the short strokes on how hemp can help the world avert a water shortage.

• Distill / desalinate or otherwise purify ocean water into clean water on ocean site or in the town/city.
• Use Hempcrete (hemp cement - info@hempcrete.ca ) to build aqueducts from the ocean to the water purification plants.
  
• Use locally grown (on government land when possible for further savings) hemp building materials to construct and stock the water plant and system, i.e hemp paper, fabrics, furnishings, etc.
• Run the water plant on hemp energy including biofuel and biomass. 
  
• Repair or rebuild sewage infrastructure with hemp materials including hemp plastic pipes. Seal all sewer tanks.  Take advantage of the upgrade further by replacing home pipes that are rusting with new hemp plastic pipes and fixtures.
• Make air and water filters from hemp, both at the plant and at the end user/citizen point.
  
• In addition to hemp medicine, a hemp empowered abundant water supply will also assist folks with health care by using what's called THE WATER CURE hydrotherapy.  
• Finance the operation from the abundant funds from a 20% recreational grade (based on THC content) hemp tax.

California Going Broke - Give Me A Break!!!

It was announced that California is in a budget crisis and going broke. The report is that the state will be out of funds by the spring.

The great and wonderful Tommy Chong said in a/k/a Tommy Chong: A Film By Josh Gilbert 'if the people elect Arnold, then we are truly a nation of retards.' Based on results, as usual Chong was right, unless another stolen election was in the mix.

The Terminator has almost terminated the state's budget while denying hemp, the will of the people as voiced in Prop 215, even though he inhaled.

It is continued insanity to pretend not to know we can solve our economic crisis with hemp.

California will run out of money by the spring UNLESS they immediately remove all restrictions from the hemp plant and generate a tax revenue from the state's #1 cash crop immediately.

Tax industrial and medical grades at standard business rates and recreational hemp at 20%. If any state gets up to 20% on all recreational hemp sold, there would be no budget crisis.

How? Legalization and large scale hemp growing would bring the price down to about $100 an ounce...plus a $20 tax. There are millions of high grade hemp consumers who would gladly pay the tax to remove the drama.

In this year's election hemp won in 9 out of 10 states where it was on the ballot. The will of the government got us into this mess. The Will of the People, hemp, can get us out.
